Deed Number 1580, Hugh Donehoe and wife to Edward Shoemaker

This indenture made the first day of April in the year of our Lord one thousand eight-hundred and fifty-two between Hugh Donehoe of Pine Township, Indiana County, Penna, and Susan his wife of the one part and Edward Shoemaker of Ebensburg, Cambria County, Pa, of the other part.

Witnesseth that the said Hugh Donehoe and Susan his wife for and in consideration of the sum of two hundred and fifty dollars lawful money of the United States of America unto them well and truly paid by the said Edward Shoemaker at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released, and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release and confirm unto the said Edward Shoemaker his heirs and assignees, all that certain tract or piece of land situate in now Pine Township, Indiana County, Penna, bounded and described as following:

Beginning at a maple a corner of land of heirs of Edmund Burke deceased?, thence by same north 29 degrees west 105 perches to a white pine. Thence north seventeen degrees east 46 perches to a white oak. Thence south 88 degrees east 144 perches to a post - a corner of R Criswell's land. These two last courses by the unsold part of the original survey of which this is a part. Thence south 10 degrees west by land of Mary McBride 137 perches to a post and stones. Thence by land of Adam Nips north 88 degrees west 104 perches to the beginning. Containing 108 acres and 38 perches more or less and the usual allowance of 6% for roadside. The same being part of a larger tract of land surveyed per warrent to John Burkholder and being the same land and premises whereon the said Hugh Donehoe now resides.

Together with all and singular the buildings, ways, waters, water courses, rights, liberties privileges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders, rents, issues, and profits thereof; and all the estate, right, title, interest, property, claim, and demand whatsoever of the said Hugh Donehoe in law, equity, or otherwise howsoever of and to the same and every part thereof.

To have and to hold the said land, hereditaments, and premeises hereby granted or mentioned and intended so to be with the appurtenances unto the said Edward Shoemaker his heirs and assigns. To and for the only proper use and behoof of the said Edward Shoemaker his heirs and assigns forever.

And the said Hugh Donehoe and Susan his wife and their heirs executors and administrators do by these presents covenant, grant, and agree to and with the said Edward Shoemaker, his heirs and assigns, that they the said Hugh Donehoe and Susan his wife and their heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended to be with the appurtenances unto the said Edward Shoemaker his heirs and assignees against them the said Hugh Donehoe and his wife and their heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will warrent and forever defend.

In witness whereof the said parties to thes presents have hereunto intechangeably set there hands and seals. Dated the day and year first above written.

On the first day of April Anno Domini 1852, before me the subscriber one of the justices of the peace in and for said County, personally appeared the above Hugh Donehoe and Susana his wife and in due form of law acknowledged the above indenture to be their act and deed. And desired the same might be recorded as such: And the said Susana being, of full age and separate and apart from her said husband by me thereon privately examined, and the full contents of the above deed being by me first made known unto her, did thereupon declare and say that she did voluntarily and of her own free will and accord sign, seal, and as her act and deed, deliver the above indenture deed or conveyance without any coercion or compulsion of her said husband.

The declaration of Hugh Donahoe upon oath he presents that he was born in the County of Tyrone in Ireland whence he migrated in the year eighteen hundred and eighteen and landed in the United States the same year. That it is bona fide his intention to become a citizen of the United States and to renounce forever all allegiance and fidelity to any foreign power, state or sovereignty whatever and particularly to Queen Victoria whose subject he has heretofore been.
